Scribble Talk User Agreement

Forum Rules

Scribble Talk will keep all of your personal information in the strictest confidence, not disclosing it to anyone except as described below. Upon registration as a Scribble Talk member, email addresses and other personal information are collected for the purpose of answering questions and site administration. We will only collect this personal information if you choose to share it with us. This information will be stored in a database at Scribble Talk. Your personal information, including email address, will not be sold to anyone.

Registration to and use of this site are free! If you agree to the terms, please press the Agree button at the end of the page. Note: By pressing the button you also declare that you are over the age of 13. If you would like to cancel the registration, click here to return to the forums index.

You agree, through your use of this service:

That you will not use this site to post any material which is:

  • Knowingly false, defamatory, or inaccurate
  • Abusive, vulgar, hateful, threatening, or harassing,
  • Obscene, profane, or pornographic (see more below in posting guidelines),
  • Invasive of a person's privacy, or breaking any law.
  • Copyright infringement (see below)
That you will not post any copyrighted material unless the copyright is owned by you or by this site. If copyrighted images are used for reference material, permission from the owner must be obtained and credit given. The moderators at ST will ask for electronic verification as proof of your permission from the photographer.

Works created from copyrighted reference material, even for personal use, and learning purposes will also not be allowed.

  • Example: Celebrity photos of any kind, works derived from references taken from magazines.
  • Professionally taken portraits, including school pictures.
  • Composite images made from copyrighted photos.
  • Any and all combinations of the above.

That any copyrighted photos, art, etc, used without permission of the original artist or photographer, will be removed by the administrators/moderators.

That you have not previously had an account with Scribble Talk that was removed for violation of this User Agreement.
That you are not creating this account under any false pretenses.
 
With the continued Internet copyright issues, the Scribble Talk Administrators have decided on the following new ruling to protect our participating members from possible copyright issues.

If you are a member in good standing, but choose not to post or participate in the Scribble Talk forums, you will be contacted by the Scribble Talk Administrators after a period of time. You'll be asked for your full name, location and your reason for visiting Scribble Talk. We require that you reply to us with that information, within the stated time period, or your viewing privileges will be restricted until we receive your response. All personal information is private and will not be shared or sold for any reason, unless legal issues prevail.

Please cooperate with the Administration or your privileges will be completely removed.

All registrations must be approved by an administrator before they are activated for normal use. Once the registration form is completed and reviewed, an email will be sent to you with instructions on how to activate your account.

Posting Guidelines

All images and content posted by members remains the property of the owner. However, by posting information to this site, you explicitly grant Scribble Talk specific permission to display said content on its website and to its members. As such, we do not remove accounts that have activity (posts, project entries, etc.). You acknowledge that you have sufficient written permission of any recognizable models or other persons appearing in your image to be able to grant to Scribble Talk the right to publish the submission online, and hereby grant to Scribble Talk such right.

Scribble Talk moderators will try to review all messages posted, however Scribble Talk is not responsible for the content of any of these messages. Scribble Talk reserves the right to delete any message for any reason and without notification. You, the member, remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless Scribble Talk, its moderators and administrators with respect to any claims, damages, losses, costs and liabilities (including reasonable attorney's fees) based upon transmission of your messages or your content, or that of anyone acting with your permission or with your password. Scribble Talk reserves the right to reveal your identity, and any known information, in the event of a complaint or legal action resulting from any message posted by you.

Messages posted express the views of the author of the message, not necessarily of this site, its moderators, administrators or any entity associated with this site.

With regard to the posting of nude and/or erotic works of art:

Works of art depicting the nude human form are permitted in this forum, provided that it is not blatant pornography. Scribble Talk administrators/moderators will be the judge as to what is considered pornographic in nature.

Valid entries include:

  • Nudes, studies of the human form, etc.
  • Works displaying sexual activities ARE permitted, provided the art is tasteful, and does not illustrate the perspective of physical penetration.
  • Posting pornographic photographs would obviously not qualify
There is a special icon (a smilie with Nudity across it) for nude posts. Please use this icon to denote material that should be viewed by mature audiences only (you can choose this icon at the time of posting).
 

Avatars

  • Flashing Avatars are not allowed.

Signature Lines / Banners

Signature lines and banners will comply with the following guidelines:

  • No company logos in signature line or banner
  • No animation in signature line or banner
  • Two link to an art related website is allowed in signature line.
  • Quotations must comply with user agreement
  • Maximum banner size is 60 x 468 pixels
  • Banners cannot link directly to websites
  • No nudity in banners
Private Messaging System
The Private Messaging system is a facility only available to registered members of Scribble Talk. Private messages are stored on our server. Your private message folders will not be opened except to investigate a report of abuse, to protect our servers, or if required to do so by law.

Three-Strike Policy

Unfortunately, there may occasionally be the need for the site administrators to take action against a member for continued non-compliance with the rules and guidelines of this site.

  • The first two warnings will come from site moderators, and will state the offense and ask politely that you adhere to site guidelines.
  • The third offense note will result in permanent suspension.

Site Anti-Solicitation/Spam Policy

This is an important section! If you are a representative of a vendor/retailer, product manufacturer, service provider, or charitable organization (hereafter collectively referred to simply as "vendors"), and you wish to participate in our community, we urge to carefully read the following information.
In short:
 
  • No blatant spamming or abuse of our system to further your business or charitable organization.
  • Vendors can respond to technical questions posed by other members.
  • Vendors cannot conduct marketing/selling operations embedded within technical responses.

No blatant spam, open solicitations, or "stealth" marketing techniques

Commercial, charitable, or monetary solicitations of ANY SORT are not permitted in this community without prior written consent by the administrators. This includes subtle, indirect offers posted in our message forums.

If a member asks a question about a product you make or sell (such as where to locate), has a complaint about a product or service, or asks about classes that you teach, then you may respond to those questions and provide a link to your website. You may NOT provide pricing information etc. in the forums.

The following are examples of things that are NOT permitted, and are considered solicitous in nature:

  • Direct solicitations for selling of products or services
  • Use of Scribble Talk forums for working out service or product complaints.
  • Direct solicitations for contributions to charity (unless approved by the site administrators).
  • Indirect solicitations or offers, disguised, or embedded within other information. This includes the use of message posts to discuss or promote (directly or indirectly) your products and/or services (unless you are responding to a technical question posed by one of our members - see below for further information on this).
  • Use of message posts (including the "signature" line area) to convey solicitous information, such as special deals, sales, inventory availability (or other stock-level information), shipping or payment terms, phone numbers, reference to other vendor sites or other such information. NOTE: A single line link to your company's web site is permitted in your signature line.
  • Use of private messaging to conduct promotion or selling of products and services.
  • Use of company logos for avatar/tiny head images is not allowed.

Politics and Religion

  • There will be no posts, avatars, or signatures that promote religious or political views. This is an international site for artists and it is inappropriate to promote your political or religious views on this site.
  • Religious or politically inspired works of art are appropriate, however threads are not to be used to discuss or debate religious or political beliefs.
  • Since our political and religious lives are many times a part of who we are, we can mention our activities related to this in the Cafe, provided the discussion doesn't promote one point of view. An example would be discussing that you went to a rally for someone, or that you just celebrated your child's confirmation or bar mitzvah.

The determination of whether a posting violates this anti-solicitation/spam Policy will be in the sole discretion of the Moderators/Administrators. Any post found in violation of the above policies may be summarily removed or edited by our staff. Any member signature or avatar in violation of these rules will be automatically edited.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL SCRIBBLE TALK BE LIABLE FOR ANY SPECIAL, INCIDENTAL, DIRECT, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT RESULT OR ARISE OUT OF YOUR USE OR INABILITY TO USE SCRIBBLE TALK , EVEN IF SCRIBBLE TALK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SCRIBBLE TALK'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) EXCEED THE LESSER OF THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SCRIBBLE TALK NET WEB SITE OR $ 25.00.

Scribble Talk reserves the right, at its sole discretion, to change, modify, add or remove any provisions herein at any time. Your continued use of the site following the posting of any changes to these provisions will signify your agreement to the changes.
